1. General Provisions
1.1. These Terms and Conditions of Use (hereinafter — the “Terms”) constitute a legally binding document governing the rights, obligations, and liability of the Purchaser (Passenger) and the Service Provider (Seller), and setting out the conditions for the purchase, payment, delivery, and refund of hot air balloon flight tickets (vouchers), as well as the general conditions of service provision.
1.2. The Website is an online store accessible at www.padangiugeles.lt, through which visitors may purchase hot air balloon flight tickets (gift vouchers).
1.3. The Seller (Service Provider) is the Hot Air Balloon Club “Padangių Gėlės” (legal entity code: 186440795, registered address: M. K. Oginskio g. 8, Nemenčinė, LT-15172 Vilnius District, email: [email protected], telephone: +37069945737).
1.4. The Purchaser (Passenger) is a legally capable natural person who has reached the age of majority, or a legal entity, acquiring services through the Website. Minors may participate in flights only when accompanied by an adult or upon submission of written consent from a parent or legal guardian.
1.5. The Seller reserves the right to amend these Terms at any time. The Terms applicable at the time of order submission shall govern any given purchase transaction.
2. Formation of Contract and Description of Services
2.1. The contract of sale shall be deemed concluded from the moment the Purchaser, having formed a basket and reviewed these Terms, clicks the “Buy / Pay” button and completes the payment.
2.2. The Seller sells, and the Purchaser acquires, a hot air balloon flight ticket / gift voucher (hereinafter — the “Ticket”).
2.3. The Ticket constitutes confirmation of the Purchaser’s (Passenger’s) advance payment for a hot air balloon flight service and grants the right to use that service within the Ticket’s validity period.
3. Pricing and Payment
3.1. All Ticket prices displayed on the Website are denominated in euro (EUR) and are inclusive of all applicable taxes.
3.2. The Purchaser may settle payment for Tickets using the following methods:
3.2.1. Online banking services provided by Lithuanian and foreign banking institutions.
3.2.2. Bank payment cards, including Visa, Mastercard, and Maestro.
3.2.3. Mobile wallets, including Apple Pay and Google Pay.
3.3. All payments are processed through the platforms of certified third-party payment service providers (e.g., “OPAY”, “Montonio”). The Purchaser’s payment data are transmitted via a secure, encrypted connection. The Seller does not collect or store the Purchaser’s payment card details.
3.4. Where payment is made by credit or debit card, 3D Secure authentication applies — the Purchaser may be redirected to the card-issuing bank’s website for additional identity verification.
3.5. The Ticket and order confirmation shall be dispatched to the Purchaser’s email address only upon receipt of full payment.
4. Delivery of Tickets
4.1. Electronic Tickets (in PDF format) are delivered automatically to the email address specified by the Purchaser immediately upon successful completion of payment, free of charge.
5. Rights, Obligations, and Health Requirements of the Purchaser (Passenger)
5.1. The Purchaser is entitled to use the purchased Ticket within its validity period, provided that the flight date and time have been agreed in advance with the Seller by telephone or email.
5.2. The Passenger is obliged to arrive at the agreed departure location at the scheduled time. Late-arriving passengers will not be awaited, and the flight shall be deemed to have taken place, resulting in the automatic cancellation of the Ticket.
5.3. Health Requirements: A hot air balloon flight is an active leisure activity. The Passenger assumes sole responsibility for their physical fitness and state of health. Pregnant women, individuals who have recently undergone surgery, and persons with cardiac, circulatory, musculoskeletal, or joint conditions are strongly advised to consult a physician prior to the flight and to inform the pilot accordingly.
5.4. It is strictly prohibited to participate in a flight under the influence of alcohol, narcotic substances, or other psychotropic substances. The pilot reserves the right to refuse to carry any passenger who appears to be intoxicated; in such cases, no refund shall be issued.
5.5. During the flight, the Passenger is unconditionally obliged to comply with all instructions issued by the pilot.
6. Rights of the Seller (Pilot) and the Effect of Weather Conditions
6.1. Hot air balloon flights are directly dependent on meteorological conditions, including wind speed, precipitation, visibility, and the probability of storm activity.
6.2. Safety is the paramount consideration. The pilot reserves the right to cancel a scheduled flight at any time — including after passengers have arrived at the departure point — should weather conditions be deemed unsafe.
6.3. In the event of a cancellation due to adverse weather conditions, no refund shall be issued; however, the Purchaser (Passenger) shall be entitled to reschedule the flight to an alternative date within the Ticket’s validity period.
6.4. The pilot reserves the right to modify the departure location having regard to wind direction and speed.
7. Ticket Validity, Refunds, and Right of Withdrawal
7.1. A Ticket (gift voucher) is valid for a period of twelve (12) months from the date of purchase, unless a different validity period is indicated on the Ticket itself. Upon expiry of the validity period, the Ticket shall be automatically cancelled and no refund shall be issued.
7.2. Right of Withdrawal within 14 Days: The Purchaser has the right to withdraw from the contract concluded through the Website, without stating any reason, within fourteen (14) calendar days of the date of purchase and to obtain a full refund of the amount paid, provided that the Ticket has not been used and no flight reservation for a specific date has been made.
7.3. To exercise the right of withdrawal within the 14-day period, the Purchaser must submit a written request in free form to [email protected], specifying the order number and the bank account details for the refund.
7.4. Cancellation of a Reservation: The Purchaser (Passenger) has the right to cancel a confirmed flight reservation no later than forty-eight (48) hours prior to the scheduled flight time. Where a reservation is cancelled within this period, the Ticket shall remain valid and the flight may be rescheduled to an alternative date.
7.5. Should the Passenger cancel the reservation less than forty-eight (48) hours before the scheduled flight, or fail to appear at the departure point, the Ticket shall be deemed used and no refund shall be issued.
7.6. In the event of a dispute — including the initiation of a chargeback procedure through the Purchaser’s card-issuing institution — the Seller reserves the right to submit to the relevant bank documentary evidence regarding the use of the Ticket, the Passenger’s failure to appear, or the cancellation of the flight due to meteorological conditions.
8. Dispute Resolution
8.1. Any disputes arising from or in connection with the performance of these Terms shall be resolved, in the first instance, through good-faith negotiations between the parties.
8.2. Should the parties fail to reach an amicable resolution, the Purchaser (consumer) may submit a request or complaint regarding a service purchased through the Website to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, email: [email protected], website: www.vvtat.lt) or submit a complaint through the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/odr/.
8.3. Disputes that cannot be resolved through negotiation shall be referred to the competent courts of the Republic of Lithuania, with jurisdiction determined by the registered seat of the Seller.
